Section 7
Adjustment of government service employees

(1) Based on the application made in accordance with the notice published in accordance with section 5 in the organization structure and positions according to section 3, the organization structure and positions at the federal, state and local levels shall be adjusted by the organization structure and positions according to the basis mentioned in section 8. Adjustments will be made in the services of the union, state and local levels.

(2) When making adjustments according to sub-section (1), adjustments will be made as follows:-

(a) In the case of adjustment in the service of the Union, in the relevant service, group, sub-group, category or level post,

(b) In the case of adjustment in the service of the province, in the sub-section of the relevant service, group, sub-group (4) at the level to be maintained, and

(c) when adjusting to the service of the local level, the relevant service, at the level to be maintained as per sub-section (4) of the group.

(3) Notwithstanding anything written in sub-section (2), in the case of permanent employees who were appointed in the government service before the commencement of the Staff Adjustment Ordinance, 2075, but who were not placed in the post when the organization structure and posts were approved in accordance with section 3, for the position of the relevant service, group If the prescribed minimum educational qualification is met, the Ministry may adjust any service or group position that meets the educational qualification of the provincial or local level service in accordance with the decision of the directive and coordination committee under section 17 on the recommendation of the service conducting body.

(4) Subsection According to (2) and (3), when the employees employed in the government service are adjusted to the provincial or local level, the adjustments will be made in such a way that the level match and grade (salary increase) will be maintained as follows based on the employee's service period and educational qualification:-

(5) When an employee without a rank is adjusted to the service of the province or local level, he will be adjusted so that he gets two grades more than the grade he has come.

(6) If the salary maintained during the adjustment of the employee according to this section is lower than the salary he received in the previous year, the salary will be adjusted by adding grades.

(7) Regardless of what is written in the existing law, if the grade added to the service of the province or local level in accordance with sub-sections (4) and (5) is higher than the maximum grade that such an employee can get, the added grade will also be given.

(8) Regardless of what is written in sub-section (4), the employees working in the government service at a level, in case of adjustment at the state or local level, will be adjusted to the relevant level of service at the state or local level. The employees who have been adjusted in this way will be added two grades to the grade they have received. In the case of such employees, the provision of sub-section (6) and (7) shall also be applicable.

(9) According to this section, when the government service employees are adjusted to the services of the Union, State and local level, gazetted first class or equivalent and so The posts above will be adjusted by the Government of Nepal and related service agencies in other positions.

(10) Notwithstanding anything else written in this Act, the Nepal Legislature-Parliament Service established in accordance with the Legislature-Parliament Secretariat Act, 2064 The employees will be adjusted at the federal, state and local levels.

(11) The details of the employees to be adjusted according to sub-section (10) shall be sent by the Federal Parliament Secretariat to the Ministry within seven days of the commencement of this Act and the Ministry shall within seven days of receiving such details. will adjust. While adjusting in this way, the employees of the general administration group of the Nepal Legislature-Parliament Service under section 8 of this Act will be adjusted to the administrative service of the provincial civil service, the general administration group or the administrative service of the local service, and the employees of other groups will be adjusted to the corresponding group.

(12) The calculation of transfer/promotion/seniority of the employees who are adjusted according to sub-section (11) will be the same as the government service employees who are adjusted according to this Act.
